S 14(2) of Sale of Goods Act, 1979 provides that, â€Å"Where the seller sells goods in the course of a business, there is an implied condition that the goods supplied under the contract are of merchantable quality...† Also, the defect in t he machine was not drawn to the attention to the attention of the buyer nor the buyer could have unveiled the defect through his examination of the machine.
